Terms of Service

1. Acceptance of Terms

By accessing or using the The Agent Trust platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and The Agent Trust.

2. Definitions

  • "Platform" — The The Agent Trust website (theagenttrust.com) and all associated services.
  • "User" — Any person who accesses or uses the Platform, including homeowners, agents, and agencies.
  • "Agent" — A real estate professional who creates a profile on the Platform to receive leads and manage their reputation.
  • "Agency" — A real estate agency that creates a profile on the Platform to manage its brand and receive leads.
  • "Lead" — A contact request submitted by a homeowner to an Agent or Agency through the Platform.
  • "Credit" — A unit purchased by Agents or Agencies to unlock Lead contact details.

3. Eligibility

You must be at least 18 years old to use the Platform. Agents must hold a valid AMI license (Licença de Mediação Imobiliária) issued under Lei n.º 15/2013. Agencies must be legally registered businesses in Portugal. By creating an account, you represent that you meet these requirements.

4. Service Description

The Agent Trust is a real estate professional directory and reputation platform that connects homeowners with verified professionals. The Platform provides:

  • For homeowners: free search, agent/agency profiles, reviews, lead submission, and professional comparison tools.
  • For agents: professional profile management, Google Business review synchronization, lead reception, dashboard analytics, and reputation building tools.
  • For agencies: agency profile management, team management, lead reception, and brand visibility.

5. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it updated. You must notify us immediately of any unauthorized access to your account.

6. Professional Profiles

Agents and Agencies are responsible for the accuracy of their profile information. The Agent Trust verifies AMI licenses but does not guarantee the accuracy of all profile data. The Agent Trust reserves the right to modify or remove profiles that contain inaccurate, misleading, or inappropriate content.

7. Lead System and Credits

Homeowners submit Leads for free. Agents and Agencies may need Credits or an active subscription to unlock Lead contact details. Consumed Credits are non-refundable. The Agent Trust does not guarantee the quality, accuracy, or conversion of any Lead. The Lead system is a communication facilitation tool, not a guarantee of business.

8. Subscriptions and Payments

Paid features are billed through Stripe, Inc. Subscription plans renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time through your dashboard — cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with Portuguese consumer law (DL 24/2014). For digital services activated before the 14-day withdrawal period expires, the right of withdrawal may be waived upon your explicit consent.

9. Reviews and User-Generated Content

Reviews must be based on genuine experiences. You must not submit fake, misleading, defamatory, or incentivized reviews. The Agent Trust reserves the right to moderate, edit, or remove reviews that violate these Terms or applicable law. By submitting a review, you grant The Agent Trust a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your review on the Platform. The Agent Trust may synchronize reviews from Google Business profiles with the consent of the profile owner.

10. Intellectual Property

The The Agent Trust brand, logo, design, and all original content on the Platform are the property of The Agent Trust and are protected by intellectual property laws. You retain ownership of your user-generated content (bios, photos, reviews) but grant us a license to display it on the Platform as described in Section 9.

10.A Database and Sui Generis Right

The compilation of professional profiles, reviews, ratings, and associated content made available on the Platform constitutes a database resulting from The Agent Trust's substantial investment in obtaining, verifying, and presenting its contents. This database is protected by the sui generis database maker's right and by copyright in the selection and arrangement of its contents, under Directive 96/9/EC of 11 March 1996, as transposed into Portuguese law by Decreto-Lei n.º 122/2000 of 4 July. The Agent Trust reserves the right to prohibit and to act against the extraction and/or re-utilization of the whole or a substantial part of the database contents, as well as the repeated and systematic extraction or re-utilization of insubstantial parts where such acts conflict with the normal exploitation of the database or unreasonably prejudice the legitimate interests of The Agent Trust.

Permitted access for search engines and AI assistants: The Agent Trust intentionally makes its public content available for indexing by legitimate search engines and AI-answer agents (including, but not limited to, Googlebot, Bingbot, and equivalent AI agents) for indexing, search, and answer-generation purposes. Such access is expressly authorized provided it respects the instructions in the Platform's robots.txt file and does not involve bulk reproduction of the database to build a competing service. The prohibition set out in these Terms targets unauthorized commercial bulk extraction and re-utilization, not indexing for search or AI-generated answers.

The Agent Trust collects publicly available information from third-party sources in compliance with their robots.txt instructions and applicable terms, and expects reciprocal respect for access to its own database.

11. Prohibited Conduct

You agree not to:

  • Provide false or misleading information in your profile, leads, or reviews.
  • Submit fake, purchased, or incentivized reviews.
  • Send unsolicited communications or spam through the Platform.
  • Access, extract, harvest, collect, copy, index for commercial purposes, aggregate, or re-utilize, whether by automated means (scraping, crawling, bots, scripts) or manually, a substantial part of the profiles, reviews, text, ratings, or any other content of the Platform, or carry out repeated and systematic extraction of insubstantial parts that, taken together, prejudice the normal exploitation of the database; or circumvent, disable, or interfere with any technical protection measures, access limits, or the Platform's robots.txt file.
  • Use the Platform for any illegal purpose or in violation of applicable law.
  • Impersonate another person, agent, or agency.

12. Platform Intermediary Role

The Agent Trust is a technology platform that facilitates connections between homeowners and real estate professionals. The Agent Trust is NOT a party to any real estate transaction, does NOT provide real estate advice, and does NOT act as a real estate mediator. The Agent Trust is not responsible for the conduct, quality of service, or professional competence of any Agent or Agency listed on the Platform. In accordance with the Digital Services Act (Regulation (EU) 2022/2065), The Agent Trust acts as an intermediary service provider.

13. Limitation of Liability

To the maximum extent permitted by Portuguese law, The Agent Trust shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. The Agent Trust's total liability shall not exceed the amount paid by you to The Agent Trust in the 12 months preceding the claim. This limitation does not affect your statutory rights as a consumer under Portuguese law.

14. Suspension and Termination

The Agent Trust may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or upon reasonable grounds. You may delete your account at any time through your dashboard or by contacting us. Upon termination, your right to use the Platform ceases immediately, but provisions that by their nature should survive (intellectual property, limitation of liability, governing law) will continue to apply.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated at least 15 days in advance via email or a prominent notice on the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Portuguese Republic. Any disputes arising from or related to these Terms shall be submitted to the courts of Lisbon, Portugal, without prejudice to any mandatory consumer protection provisions that may apply under Portuguese or EU law. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
